    Agreement to Terms

    These Terms of Service ("Terms") govern your access to and use of the Posting Cuteness website located at postingcuteness.com (the "Site"), and your purchase of any product or service offered through it. The Site and the custom pet portrait business are operated by Posting Cuteness ("Posting Cuteness," "we," "us," or "our").

    By accessing or using the Site, or by placing an order, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Site or place an order. If you are placing an order, you confirm that you are at least 18 years old and able to enter into a binding contract.

    Changes to These Terms

    We may update or modify these Terms from time to time. Changes take effect when posted to this page, and the "Last Updated" date will reflect the most recent revision. The Terms in effect at the time you place an order govern that order. Your continued use of the Site after changes are posted constitutes acceptance of the updated Terms, so we encourage you to review this page periodically.

    About Our Product

    Posting Cuteness sells a custom pet portrait created from a photo you provide. You upload one photo of your pet, we generate a portrait in your chosen style from that photo, and we produce it as a physical print fulfilled on demand through our print partners (such as Printify and Gelato). A free, full-resolution digital file of your finished portrait is included with every order.

    Each portrait is made to order and personalized to you. Because it is produced specifically for you from your photo, it is a custom item, and certain consumer cancellation rights that apply to standard off-the-shelf goods may not apply once production has begun. Your statutory rights, where they apply, are not affected, and our money-back guarantee (described below) applies regardless.

    How the Portrait Is Created (AI Generation Disclosure)

    We want to be clear and honest about how your portrait is made. Your portrait is generated using artificial intelligence (AI) from the photo you upload, rendered in the style you select, and then printed. It is not hand-painted or hand-drawn by a human artist, and we do not represent it as original handmade fine art.

    Because the artwork is AI-generated, the final result is an artistic interpretation of your pet, not a photographic reproduction. Colors, brushwork, background, and fine details will vary by style, and exact likeness cannot be guaranteed on the first attempt. This is exactly why we send you a proof to approve and offer unlimited revisions and a money-back guarantee, all described below — so you only pay for a portrait you are happy with.

    Orders and Acceptance

    When you place an order through the Site, you are making an offer to purchase the selected product at the price displayed at checkout. Your order is not accepted, and no contract is formed, until we confirm acceptance (for example, by sending an order confirmation or by beginning production).

    We reserve the right to refuse, cancel, or limit any order at our discretion — for example, if a product is unavailable, if we suspect fraud or a policy violation, if the uploaded photo does not meet our acceptable-content rules, or if there has been an error in pricing or product information. If we cancel an order after you have been charged, we will issue a refund of the amount paid for the cancelled items.

    Pricing and Payment

    Current introductory pricing for our products and options is shown on the product page and at checkout, and is stated in U.S. dollars. We may change prices at any time, but the price that applies to your order is the price displayed at checkout when your order is accepted.

    The price shown at checkout is server-authoritative. Final pricing, totals, and any applicable taxes are calculated and confirmed by our systems at checkout, and that calculation controls over any price shown elsewhere on the Site, in marketing, or in a cached or modified page. If a product is listed at an incorrect price due to a typographical, system, or other error, we are not obligated to honor that price; we may cancel the affected order and refund any amount charged, even after an order confirmation has been sent.

    Payments are processed through Stripe Checkout, a hosted, secure checkout. Stripe is our payment processor, and the Site never stores your full card details. We accept payment cards and, where enabled, digital wallets such as Apple Pay, Google Pay, and Link. Promotional codes are only applied through a valid promotional link and may be limited, conditional, or withdrawn at any time.

    Your Photo: Rights, Warranties, and License

    To create your portrait, you upload a photo of your pet. You may provide your photo at the time you add the item to your cart, or send it to us after checkout. You retain ownership of the photo you upload.

    By uploading or sending us a photo, you represent and warrant that:

    • you own the photo or otherwise have all rights and permissions necessary to use it and to authorize us to use it as described here;
    • you have the consent of any person who appears in the photo and of any photographer or other rights holder, where such consent is required; and
    • your use of the photo, and our creation of a portrait from it, does not infringe any copyright, trademark, privacy, publicity, or other right of any third party.

    You grant us a limited, non-exclusive, worldwide, royalty-free license to use, store, reproduce, and modify your uploaded photo solely for the purpose of creating, producing, fulfilling, and revising your portrait order and providing related customer support. We do not claim ownership of your photo, and we do not use your photo for advertising or any unrelated purpose without your separate permission.

    Uploaded photos are stored using a third-party storage provider (Supabase) and are used only to create your portrait. Photos are retained for the duration of order fulfillment and for 90 days after delivery, after which they are permanently deleted.     Acceptable Photos and Content

    To get the best result and to keep our service safe and lawful, the photo you submit must meet these rules. You agree not to upload any image that:

    • you do not own or do not have permission to use;
    • contains content that is unlawful, infringing, defamatory, obscene, hateful, harassing, or otherwise objectionable;
    • depicts sexually explicit material, graphic violence, or the abuse or exploitation of any animal or person;
    • contains malware or attempts to interfere with the Site or our systems; or
    • violates the rights or privacy of any third party.

    We may decline to produce a portrait from any photo that violates these rules or that we cannot reasonably use, and we may cancel and refund the affected order. For the best likeness, we recommend a clear, well-lit, in-focus photo of a single pet; portrait quality depends in part on the quality of the photo you provide.

    Ownership of the Finished Portrait

    Upon full payment for your order, you receive the physical print(s) you purchased and the free full-resolution digital file of your finished portrait for your personal use. You may display, print, and enjoy your portrait for personal, non-commercial purposes.

    We retain all rights in our own underlying styles, templates, models, prompts, and production processes used to create portraits. Nothing in these Terms transfers any rights in those tools or in our brand, and the license to your finished portrait does not include the right to resell it commercially or to reproduce it for commercial distribution without our written permission.

    Proof Approval and Revisions

    After you order, we create a digital proof of your portrait and send it to you to review, typically within 2 to 4 days. Nothing is printed until you approve your proof.

    If the likeness is not right, you may request changes. We offer free, unlimited revisions until you are satisfied with the likeness. Once you approve the proof, we move your portrait into production. Please review your proof carefully — by approving it you confirm the artwork, style, and any text or details are correct for printing.

    Production, Delivery, and Shipping

    Portraits are produced on demand through our print partners. After you approve your proof, framed pieces ship within 3 to 5 business days. A rush option is available at checkout if you need your order sooner.

    Shipping is free, tracked, and available within the United States only. Our checkout collects U.S. shipping addresses only, and no separate shipping charge is added at checkout. Our products are made in the USA. Delivery time after shipment depends on the carrier and your location; we are not responsible for carrier delays once an order has been handed off for delivery, though we will help you track and resolve any shipping issue.     Refunds and Money-Back Guarantee

    Because you approve a proof before anything is printed, and because we offer free unlimited revisions until the likeness is right, you have the chance to get your portrait exactly right before production. If after working with us the likeness still isn't right, we offer a money-back refund.

    Use of the Site

    You may use our Site only for lawful purposes and in accordance with these Terms. You agree not to:

    • Use the Site in any way that violates any applicable law or regulation
    • Use the Site to transmit any advertising or promotional material without our prior consent
    • Impersonate or attempt to impersonate Posting Cuteness, an employee, another user, or any other person
    • Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Site
    • Use any robot, spider, or other automatic device to access the Site for any purpose
    • Introduce any viruses, trojan horses, worms, or other harmful material
    • Attempt to gain unauthorized access to any portion of the Site

    Intellectual Property of the Site

    The Site and its contents, features, and functionality (including all text, displays, images, video, audio, design, software, and our styles, templates, and models) are owned by Posting Cuteness, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

    You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Site without our prior written consent, except for your own personal, non-commercial use. This section governs our Site and brand content; rights in the photo you upload and in your finished portrait are addressed in the photo and portrait-ownership sections above.

    User-Submitted Content

    Apart from the photo you submit to order a portrait (which is governed by the photo sections above), the Site may allow you to submit other content such as comments, reviews, or feedback. You retain ownership of content you submit, and you grant us a non-exclusive, royalty-free license to use, reproduce, and display that content in connection with operating and promoting the Site.

    You represent and warrant that any content you submit does not violate any third-party rights and complies with these Terms and all applicable laws. We may remove any submitted content at our discretion.

    Copyright Infringement (DMCA)

    If you believe that any content on our Site infringes upon your copyright, please notify us at support@postingcuteness.com with the following information: a description of the copyrighted work, the location of the infringing material on our Site, your contact information, a statement that you have a good faith belief that the use is not authorized, and a statement under penalty of perjury that the information in your notice is accurate.

    Third-Party Links and Services

    Our Site may contain links to, or rely on, third-party websites and services that are not owned or controlled by Posting Cuteness, including our payment processor (Stripe), our print and fulfillment partners (such as Printify and Gelato), and our storage and analytics providers. We have no control over and assume no responsibility for the content, policies, or practices of third-party websites or services. Your use of a third-party service may be subject to that provider's own terms and privacy policy.

    Disclaimer of Warranties

    THE SITE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. POSTING CUTENESS DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

    Because each portrait is an AI-generated artistic interpretation of your photo, we do not warrant that a portrait will match your pet exactly or meet any particular expectation of likeness on the first attempt. Our proof-approval process, unlimited revisions, and money-back guarantee are your remedies for likeness concerns. Nothing in this section limits any warranty or right that cannot be excluded under applicable law.

    Limitation of Liability

    TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL POSTING CUTENESS, POSTING CUTENESS, OR ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR ANY PRODUCT. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SITE OR A PRODUCT SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID FOR THE ORDER GIVING RISE TO THE CLAIM.

    Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you. Nothing in these Terms excludes liability that cannot be excluded under applicable law.

    Indemnification

    You agree to defend, indemnify, and hold harmless Posting Cuteness, Posting Cuteness, and its affiliates, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms, your use of the Site, or any photo or content you submit (including any claim that a photo you uploaded infringed or violated a third party's rights).

    Governing Law

    These Terms and any dispute arising out of or relating to them, the Site, or any product are governed by the laws of the State of California, without regard to conflict-of-law principles. Any legal action shall be brought exclusively in the state or federal courts located in Sacramento, CA, and you consent to the personal jurisdiction of those courts.

    Severability

    If any provision of these Terms is held to be invalid or unenforceable, that provision shall be struck or limited to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

    Entire Agreement

    These Terms, together with our Privacy Policy, Refund Policy, and Disclaimer, constitute the entire agreement between you and Posting Cuteness regarding the Site and any product, and supersede all prior understandings and agreements on that subject.
